Use and Disclosure of Personal Data Consent Form ("Consent Form")

This Consent Form sets out how, we, Touch EMAS Limited and its subsidiary Touch Bionics Inc. (hereinafter "Touch Bionics") may collect certain personal information from you via the Patient Care Pathway web portal www.touchbionics.com/portal (the "Portal") and from the other sources listed below and how we use and disclose this information.

At Touch Bionics, we take your privacy seriously. Because we gather certain types of information about our customers we want you to understand the purposes for which we will use your personal information and the third parties to whom we disclose it and we would like you to expressly consent to those uses and to our sharing this information with such third parties.  This Consent Form discloses the types of information we gather, how we use it and how to correct or change it.

To protect you from any unintentional unauthorised use of your data by us, you will not be able to access the Portal without giving your consent to our use of your personal data in accordance with this Consent Form.

In order to be able to access the Portal, please check the box at the bottom of this Consent Form to show that you agree and consent to our use of your personal data in accordance with this Consent Form. If you do not agree to our use of your personal data in accordance with this Consent Form please do not check this box.

Any changes to these policies will be posted on the Portal and any questions regarding this Consent Form should be sent to info@touchbionics.com.

 

1. What information do we collect about you?

We collect personal details such as:

  • your name, address, telephone number, email address;
  • sensitive type information such as medical, clinical and/or health type information;
  • preferences and other information regarding your use of the Portal your computer, preferences as described in more detail below; and
  • information relating to the usage of your prosthesis.

We collect such personal data from you from a variety of sources. These sources include information you provide by filling forms on our website (www.touchbionics.com), the Portal, downloading software, or through competitions, exhibitions, seminars, emails surveys, correspondence and personal telephone calls.

Touch Bionics also:

  • sometimes tracks email messages sent from our servers to analyse how many people open the email and which links are clicked upon. This information is used to help increase the relevancy and quality of future emails. If you would like the emails you receive to exclude any tracking tools then please contact us at info@touchbionics.com .
  • collects information regarding your visits to our site, including but not limited to traffic data, location data, weblogs and other communication data and the resources that you access. We may also collect information about your computer, including where available, your IP address, operating system and browser type.
  • uses cookies. Cookies are small file of letters and numbers which we put on your computer which distinguish you from other users of our website. This helps us distinguish you from other users of our website and helps provide you with a good experience when you browse our website and also allows us to improve our site. We use cookies. The types of cookies we use are "analytical" cookies. They allow us to recognise and count the number of visitors and to see how visitors move around the site when they are using it. Touch Bionics will take all steps reasonably necessary to ensure that your data is treated securely and to try to prevent unauthorised access to your data. 

2. Use of data

We may use your personal data in the following ways:

  • with the aim that content from our site is presented in the most effective manner for you and for your computer;
  • to share information with your clinician and/or insurance provider as described in more detail in section 3 of this Consent Form ;
  • to provide you with relevant information on Touch Bionics' products and services, a regular newsletter or any other information requested by you; and.
  • to conduct outcomes analysis and published, anonymous reports regarding customer experiences with Touch Bionics' products and services.

3. Disclosure of your information to third parties

We will never sell or rent your data to third parties, however we may share your personal information with third parties as follows:

  • Your clinician, should you provide us with their details, to evaluate your progress with your prosthesis and use it to adjust your healthcare plan accordingly;
  • Your insurance provider, should you provide us with their details, in order to help process your claim for a Touch Bionics' prosthesis; and
  • Touch Bionics Inc, our subsidiary in the US (35 Hampden Road, Mansfield, MA 02048)

4. Processing of your information outside the EEA

The data that we collect from you may be transferred and stored at a destination outside the European Economic Area ("EEA"). It may also be processed by parties outside of the EEA, including our subsidiary, and your clinician or insurance provider, if they are located outside of the EEA. By submitting your personal data, you agree to this transfer, storing or processing.

5. Your rights

You have the right to ask us not to process your personal data, to request us to remove your personal information, to request that we amend or correct any data or to opt out of any of our communications. Please contact marketing@touchbionics.com in the event you wish to do so.

At any time you may request to view the personal data that we have stored, in accordance with the Data Protection Act 1998. Any access request may be subject to a fee of £10 to meet our costs in providing you with details of the information we hold about you.

For your information, for the purposes of the Data Protection Act 1998:

  • the data controller is: Touch EMAS Limited (Company Number SC232512, 3 Ashwood Court, Oakbank Park Way, Livingston, West Lothian EH53 OTH; and
  • our nominated representative is: Jill McGregor, CFO.

If you consent to our using your personal information for the purposes set out in more detail above, and our disclosing your personal information to the third parties described above, please confirm this by checking the box which will enable you to use the Portal.If you do not agree to our use of your personal data in accordance with this Consent Form please do not check this box.
